This Privacy Policy describes how Darkwaters LLC, d/b/a BioForm ("BioForm," "we," "us") collects, uses, and shares personal information when you visit getbioform.com (the "Site") or purchase our products. We sell and ship only within the United States.

1. Information We Collect

Information you provide:

  • Order information: name, email address, shipping and billing address, phone number (if provided), and order details.
  • Payment information: processed by our payment processors (e.g., Shopify Payments, PayPal, Apple Pay, Google Pay). We do not store full payment card numbers.
  • Account & subscription information: login credentials, subscription preferences, and order history.
  • Communications: emails you send to our support team.

Information collected automatically:

  • Device and usage information: IP address, browser type, device identifiers, pages viewed, referring URLs, and interactions with the Site, collected via cookies, pixels, and similar technologies.
  • Advertising data: we use the Meta (Facebook) Pixel, which collects information about your visit (such as pages viewed, items added to cart, and purchases) and shares it with Meta to measure and improve our advertising and to show you relevant ads on Meta platforms.

2. How We Use Information

We use personal information to:

  • Process, fulfill, and ship orders, and manage subscriptions and renewals;
  • Send transactional emails (order confirmations, shipping notifications, renewal reminders);
  • Provide customer support and process refunds and returns;
  • Detect and prevent fraud, policy abuse, and unauthorized transactions;
  • Measure and improve our Site, products, and advertising;
  • Marketing (current and planned): with your consent or as permitted by law, send marketing emails about our products, offers, and updates. You can unsubscribe at any time via the link in any marketing email; transactional emails will still be sent.
  • Comply with legal obligations and enforce our Terms of Service.

3. How We Share Information

We share personal information with:

  • Service providers that operate our business: Shopify (our e-commerce platform), payment processors, our subscription-management provider, shipping carriers and fulfillment partners, and email service providers. These providers process information on our behalf under contractual restrictions.
  • Advertising partners: we share Site activity data with Meta through the Meta Pixel for advertising measurement and targeted advertising. Under certain U.S. state privacy laws, this may be considered a "sale" or "sharing" of personal information for cross-context behavioral advertising. You can opt out as described in Section 5.
  • Legal and safety: when required by law, subpoena, or legal process, or to protect our rights, prevent fraud, or ensure safety.
  • Business transfers: in connection with a merger, acquisition, or sale of assets, subject to this policy.

We do not sell personal information for money.

4. Cookies & Tracking Technologies

We use cookies and pixels that are essential to Site operation (cart, checkout, security), that measure Site performance, and that support advertising (Meta Pixel). You can control cookies through your browser settings; blocking essential cookies may prevent checkout from functioning. We honor opt-out requests as described in Section 5.

5. Your Privacy Choices & Opt-Outs

  • Opt out of targeted advertising / "sharing": you may opt out of the sharing of your information for cross-context behavioral advertising by [using our cookie/privacy preferences link in the Site footer] or emailing support@getbioform.com with the subject "Privacy Opt-Out." We also honor the Global Privacy Control (GPC) browser signal where required by law.
  • Marketing emails: unsubscribe anytime via the link in any marketing email.
  • Meta's controls: you can also manage ad preferences directly with Meta at facebook.com/adpreferences.

6. State Privacy Rights (California and Other States)

Depending on your state of residence (including California, Colorado, Connecticut, Texas, Virginia, and others), you may have the right to:

  • Know/access the personal information we hold about you;
  • Correct inaccurate personal information;
  • Delete your personal information;
  • Opt out of the sale or sharing of personal information for targeted advertising;
  • Non-discrimination for exercising your rights.

To exercise these rights, email support@getbioform.com with the subject "Privacy Request," specifying your request and the email address associated with your order. We will verify your identity (typically by confirming control of the order email) and respond within the time required by applicable law. You may designate an authorized agent to submit requests on your behalf; we will require proof of authorization.

California notice: In the preceding 12 months we have collected the categories of information described in Section 1, used them as described in Section 2, and disclosed them as described in Section 3. We "share" internet activity data with advertising partners (Meta) for cross-context behavioral advertising; we do not knowingly sell or share the personal information of consumers under 16.

7. Data Retention

We retain order and transaction records as needed for tax, accounting, fraud-prevention, and legal purposes; support communications as needed to resolve issues and enforce our policies; and marketing data until you unsubscribe or request deletion, subject to legal retention requirements.

8. Security

We use commercially reasonable technical and organizational safeguards, including encrypted checkout via our e-commerce platform. No system is perfectly secure, and we cannot guarantee absolute security of information transmitted online.

9. Children

The Site is intended for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.

10. Changes to This Policy

We may update this policy from time to time. The "Last updated" date reflects the current version. Material changes will be posted on the Site, and where required by law, we will provide additional notice.
